Will Atiku Abubakar remain on Nigeria's presidential ballot after court ruling?

The origins of the legal dispute

In 2025, several high-profile politicians joined the ADC following internal strife within the People's Democratic Party (PDP). Among them were Atiku Abubakar, who served as vice-president from 1999 to 2007, and former Senate President David Mark. Mark subsequently assumed the role of interim party chairman. However, former national vice-chairman Nafiu Bala Gombe challenged this, arguing that Mark and others were not elected via a national convention. Gombe claimed he was the rightful successor following the resignation of the previous ADC chairman in 2025.

A recurring legal battle

This is not the first time the Abuja Federal Court has intervened in the party's leadership structure. In July, Judge Musa Liman ruled that Mark’s appointment complied with national law and the party constitution. Abubakar questioned why a new lawsuit was permitted to reopen a settled matter. The ADC stated that Thursday’s ruling by Judge Peter Lifu was a calculated effort to stifle the opposition and sabotage Abubakar’s candidacy.

Moving forward

The ADC plans to appeal the decision. Abubakar, 79, stated on X that the ruling proves the panic is realamong his political opponents. He noted the timing was suspicious, occurring just one day after a massive campaign rally in Sokoto. Abubakar remains confident, urging supporters to stay focused on his promise to make life more affordable for Nigerians. The electoral commission’s final candidate list currently includes Abubakar and his running mate, former Rivers State Governor Rotimi Amaechi.

Impact on the opposition

The ADC is currently seen as the primary opposition to President Bola Tinubu. This legal saga creates uncertainty for hundreds of ADC candidates and raises questions regarding party authority. Abubakar, seeking the presidency for the seventh time, insists the matter will be resolved. Meanwhile, rival candidate Peter Obi expressed shock at the ruling. Writing on X, the 65-year-old urged authorities not to „undermine democracy.”Obi emphasized that public certainty is essential three months before a general election. He warned that protecting opposition parties is vital for Nigeria’s democratic stability.
